Vendor Terms & Conditions

The terms that apply to every Italian Festa vendor — stall bookings, payment, insurance, food safety, conduct and more. Please read carefully before submitting a stall application.

These terms and conditions apply to all vendors trading at Italian Festa. By submitting a stall application, you agree to be bound by these terms. [REVIEW: legal] — this entire document is a placeholder pending legal review and must be approved by the festival's legal team before publication.

1. Stall booking & confirmation

[REVIEW: legal] Stall bookings are confirmed only once the vendor has submitted a complete application, paid the applicable stall fee, and received written confirmation from the Italian Festa organising committee. The committee reserves the right to accept or decline any application at its sole discretion.

2. Payment terms

[REVIEW: legal] Stall fees are payable in full by the date stated on the booking confirmation. Late payment may result in cancellation of the stall allocation without refund. All amounts are quoted in Australian Dollars (AUD) and include GST where applicable.

3. Cancellation & refunds

[REVIEW: legal] Cancellations made more than [TODO: editor fill, e.g. 60] days before the festival may be eligible for a partial refund less an administration fee. Cancellations within [TODO: editor fill] days of the festival are non-refundable. The Italian Festa is a rain-or-shine event; stall fees are not refundable due to weather.

4. Insurance requirements

[REVIEW: legal] All vendors must hold and provide evidence of current Public Liability Insurance with a minimum cover of [TODO: editor fill, typically AUD 20,000,000]. A copy of the certificate of currency must be provided no later than [TODO: editor fill] days before the festival. Vendors trading without valid insurance will not be permitted to operate.

5. Food safety & licensing

[REVIEW: legal] Food and beverage vendors are responsible for complying with all applicable food safety laws, including the Food Act 1984 (Vic) and registration with their local council via Streatrader. Vendors must hold any required state or local government permits and present them on request. The committee may inspect food handling practices at any time.

6. Setup, operation & teardown

[REVIEW: legal] Vendors must complete setup before the festival opening time on each trading day and must not commence pack-down before the published closing time. Site allocation is at the discretion of the committee and is final. Vendors are responsible for leaving their stall site clean and free of waste; cleaning charges may apply for non-compliance.

7. Conduct & compliance

[REVIEW: legal] Vendors and their staff must comply with all reasonable directions from festival staff, security and emergency services. The committee reserves the right to remove any vendor whose conduct, products or signage is deemed offensive, unsafe or inconsistent with the festival's family-friendly nature, without refund.

8. Liability, indemnity & governing law

[REVIEW: legal] To the extent permitted by law, the Italian Festa, COASIT and their representatives are not liable for any loss, damage, injury or theft suffered by vendors or their staff. Vendors indemnify the festival organisers against claims arising from their participation. These terms are governed by the laws of Victoria, Australia.
